Labour and Employment Law

The fair labour practice jurisdiction allows for a labour law dispensation that pays due regard to the needs and interests of both employer and employee. Neither employer nor employee benefits from a static employment concept where their respective rights and obligations are cast in stone at the commencement of the employment relationship. What the employer bargains for is the flexibility to make decisions in a dynamic work environment in order to meet the needs of the labour process. What the employee exacts in return is not only a wage, but a continuing obligation of fairness towards the employee on the part of the employer when he makes decisions affecting the employee in his work” (WL Ochse Webb & Pretorius (Pty) Ltd v Vermeulen 1997 ILJ 361 (LAC):365I-366A.)

Against this backdrop, the continuous harmonious relationship between employer and employee is of cardinal importance in any workplace. We believe that continued engagement between employer, employee and organised labour, where applicable, is the best means towards achieving said harmonious relationship and this forms the cornerstone of our advisory and litigious position. Our Labour and Employment Department has over 15 years’ experience in labour and employment advisory and litigation related services.

We specialise in the following:

  • Unfair dismissal and unfair labour practice disputes
  • Retrenchment
  • Sexual harassment in the workplace
  • Strikes / lock out disputes
  • All forms of discrimination in the workplace
  • Contracts of employment
  • Restraints of trade
  • Employee Share Schemes
  • Workplace policies
  • Staff training
  • Workplace investigations
  • Disciplinary hearings
  • Mediation, Conciliation and Arbitration
